BAŞBAKANLIK GÜMRÜK MÜSTEŞARLIĞI Gümrükler Genel Müdürlüğü Sayı :B.02.1 .GUM.O.06.00.49.1566-10 Konu : 2009/4 Genelge ile 01.05.2009 tarihi itibariyle Yürürlükten Kaldırılmıştır. 15.08.2003 / 21003 GÜMRÜK VE MUHAFAZA BAŞMÜDÜRLÜĞÜNE Bilindiği üzere tedarikçi beyanına ilişkin 28 Mayıs 1999 tarihli ve 1/1999 sayılı "Avrupa Birliği, Türkiye ve Bazı Avrupa Ülkeleri Arasındaki Tercihli Ticareti Düzenleyen Hükümler Çerçevesinde EUR.1 Dolaşım Belgelerinin ve Fatura Beyanlarının Düzenlenmesini Kolaylaştırıcı Prosedürlere Dair Gümrük İşbirliği Komitesi Kararı'nın (1/99 sayılı GİK Kararı) dayandığı 14 Kasım 1983 tarihli ve 3351/83 sayılı Konsey Tüzüğü, 11 Haziran 2001 tarihli ve 1207/2001 sayılı Konsey Tüzüğüyle yürürlükten kaldırılmıştır. Bu bağlamda 1/99 sayılı GİK Kararının hükümlerini mevzuatımıza aktaran düzenleme olan ve 18 Eylül 1999 tarih ve 23820 sayılı R.G.de yayımlanarak yürürlüğe giren "Türkiye İle Avrupa Topluluğu Arasında Serbest Dolaşımda Bulunan Eşyanın Tercihli Menşe Statüsünün Kanıtlanmasına Dair Yönetmelik" hükümlerinin de 1207/2001 sayılı Konsey Tüzüğü hükümleri ile uyumlu hale getirilmesi amacıyla yeni bir GİK kararının alınması öngörülmüştür. Ancak yeni GİK Kararının kabul edilmesi ve yürürlüğe girişinin zaman alacağı düşünüldüğünden söz konusu kararın alınıp yürürlüğe girişine kadar geçen süre zarfında geçici bir uygulama olarak Topluluk ihracatçıları Haziran 2002 tarihinden itibaren kullanmakta oldukları 1207/2001 sayılı Konsey Tüzüğünün V nolu ekinde yer alan yeni INF 4 Bilgi Formu ve Başvuru Formunu Türkiye ile olan ticari ilişkileri esnasında da kullanacaklardır. Diğer taraftan Türk İhracatçıları açısından söz konusu formlara ilişkin stoklar bitmeden yeni formların basımı yapılamayacağından eski formlar kullanılmaya devam edecektir. Bilgi edinilmesi ve Topluluk ihracatçıları tarafından kullanılan ve bir örneği ilişikte gönderilen yeni INF 4 Bilgi Formu ve Başvuru Formunun kabul edilmesi hususunda gereğini rica ederim.
